These Terms of Service (“Terms”) govern your (“you”, “user”) access to and use of our Services, including our website (the „Site“), the MineTime software („MineTime“), APIs, and other products and services provided on the Site (all of the foregoing, collectively, the „Service“ or “MineTime”). Your access to and use of the Services are conditioned on your acceptance of and compliance with these Terms. By accessing or using the Services you agree to be bound by these Terms.
If you are entering into this Agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these terms and conditions, in which case the terms “User”, „You“ or „Your“ shall refer to such entity. If you do not have such authority, or if you do not agree with these terms and conditions, you must not accept this Agreement and may not use the Services.
You may not access our Services for purposes of monitoring its availability, performance or functionality, or for any other benchmarking or competitive purposes. In addition to that, you may not reverse engineer or analyze any parts of our Service.
MineTime is an app and service provided by ETH Zurich (hereinafter the “ETH”) in Switzerland. By using MineTime the user (hereinafter the “user”) confirms to have read and understood these terms of use and agrees to them.
1. MineTime is made available to the user free of charge. Some features of MineTime, however, may only be available via subscription or purchase with costs. In order to use all features of MineTime, the registration of a user account with a valid and verified email address as well as access to the Internet may be necessary.
2. MineTime is partially provided via App Stores and their associated infrastructure, for example the Apple Mac App Store and the Windows Store. The user shall use such App Stores independently from ETH, and the respective terms of use shall apply.
3. For some features, MineTime will have to access to or process or store private information of the user. See our privacy section for more information.
4. MineTime allows for sending calendar event invitations between MineTime users and third parties, including email messages and push notifications. The user expressly agrees to receive such messages. The user agrees not to send any messages via MineTime that violate the laws and agrees not to cause others to send such messages. ETH shall be entitled to contact the user with messages via MineTime, Push Notifications or email at any time.
5. ETH will not tolerate objectionable content uploaded to MineTime. MineTime respects the rights of others and you should do the same. Our users must not post or send objectionable content that violates other’s rights; bullies, harasses, intimidates, or defames others; or spams or solicits MineTime’s users. If you do send objectionable content, be prepared to be banned from MineTime. If somebody sends you objectionable content, you can send us an email using the contact forms within the application or on our website minetime.ai.
6. ETH shall endeavour to ensure a high availability and reliability of MineTime (“best effort”). However, ETH can expressly not guarantee that MineTime or individual features of MineTime are continuously, at any time and/or completely available. ETH recommends the user to make sure calendar data stays in sync with their calendar service providers (Google, Apple, Microsoft, etc.).
7. The user shall not be entitled to use MineTime. ETH may discontinue its providing of MineTime or exclude the user from using MineTime at any time without stating any reasons. ETH may change MineTime at any time without stating any reasons, in particular with regard to paid functionalities, if any.
ETH and MineTime shall be subject to Swiss data privacy laws. How ETH receives, collects and uses information about you, from your use of the Service in general, including Personal Information, is more fully described in the MineTime Privacy Policy. By using the Service, you understand and agree that we may collect, use, transfer, share and store Personal Information as described in the MineTime Privacy Policy.
Subject to mandatory legal provisions, ETH shall not assume any liability for direct or indirect damage caused by the use of MineTime or in connection with MineTime. In the case of violations of these terms of use and in the case of violation of rights and corresponding claims of third parties, the user shall expressly indemnify ETH from any liability and shall be liable for damages vis-à-vis ETH to the full extent.
Except as otherwise provided herein, MineTime and ETH is under no obligation to provide technical or customer support for the Services. You are solely responsible for properly installing and using the Services. You are responsible for the procurement of any hardware or services required to use the Services, including any computers, servers, or Internet access.
The Services are provided over the Internet. As such, the Services are subject to the operation of the Internet and telecommunications infrastructures as well as the operation of your Internet connection services, all of which are beyond the control of MineTime. MineTime does not warrant that the services will be uninterrupted or that you will be able to access or use the Services at the location and times of your choosing.
THE SERVICES IS PROVIDED TO YOU “AS IS” AND “AS AVAILABLE”. ANY USE OF THE SERVICES IS AT YOUR OWN RISK. THE SOFWARE MAY CONTAIN BUGS, ERRORS, AND OTHER PROBLEMS THAT COULD CAUSE SYSTEM OR OTHER FAILURES AND DATA LOSS. MINETIME DOES NOT WARRANT THE PERFORMANCE OF THE SERVICES, THAT THE SERVICES WILL OPERATE UNINTERRUPTED OR ERROR-FREE, OR THAT THE SERVICES WILL OPERATE IN ACCORDANCE WITH ANY ACCOMPANYING DOCUMENTATION. MINETIME IS NOT LIABLE FOR ANY DELETED, INACCESSIBLE, OR DISCLOSED DATA.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINETIME DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESSED OR IMPLIED, IN EQUITY OR AT LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MINETIME DOES NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR NEEDS. YOU SHALL BEAR THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SERVICES.
Some jurisdictions do not allow or limit the exclusion of warranties. In such jurisdiction, these provisions shall apply to you to the maximum extent allowed by law.
ETH may change these terms of use at any time.The user will be informed about such changes in a suitable manner. The user may discontinue the use of MineTime at any time. By continuing the use of MineTime after changes of these terms of use have been notified, the user shall expressly consent to such changes. Subject to mandatory legal provisions, the use of MineTime shall be exclusively governed by Swiss laws with Zurich (Switzerland) being the exclusive place of jurisdiction.
